These Terms explain the conditions that apply when you visit this website, submit an inquiry, or commission artwork from Legacy Pet Studio.

Legacy Pet Studio creates highly personal commissioned portraits and handcrafted presentation pieces. These Terms establish a clear foundation for using this website and beginning a client relationship with the studio.

Acceptance and Eligibility

These Terms govern your use of this website and your communications with Legacy Pet Studio. By using the website or submitting an inquiry, you agree to these Terms. If you do not agree, please do not use the website.

You must be at least 18 years old to submit an inquiry or enter into a commission agreement.

Website Information

This website presents general information about Legacy Pet Studio, its portrait services, process, pricing, and custom framing. Website content is provided for general informational purposes and may be updated without notice.

Submitting an inquiry does not create a client relationship, reserve a place on the studio schedule, or obligate either party to proceed. The website does not currently accept online orders or payments.

Portrait Commissions

Every commission is individually defined. Before work begins, the client and Legacy Pet Studio will confirm the project scope, price, payment schedule, source materials, and other relevant details in a separate written Commission Agreement.

If these Terms conflict with a signed Commission Agreement, the Commission Agreement will control for that particular project.

Retainers, Cancellations, and Delays

An initial retainer is required to begin a commission. The retainer is refundable only if Legacy Pet Studio has not begun project-specific work. Once work begins—including review or preparation of source materials, concept development, or image creation—the retainer becomes nonrefundable.

Completion dates are estimates rather than guaranteed deadlines. Illness, emergency, material availability, production delays, or circumstances beyond the studio’s reasonable control may extend the schedule. Legacy Pet Studio will communicate significant delays. If the studio ultimately determines that it cannot complete the commission, all funds received for the uncompleted project will be refunded, ending the studio’s remaining obligation for that commission.

Revisions and Changes in Scope

The commission price includes reasonable revisions consistent with the originally approved concept. Major changes in direction, replacement of source photographs, additions to the composition, or other requests outside the agreed scope may require an additional fee.

Any additional charges will be disclosed to the client for approval before the related work begins.

Final Approval and Production

Final approval authorizes Legacy Pet Studio to prepare and submit the artwork for production. Once the artwork has been submitted to a printer, framer, or other production provider, client-requested changes will be treated as additional work.

The client is responsible for resulting redesign time, reprinting, materials, framing, shipping, and other production expenses. Production errors attributable to Legacy Pet Studio or its vendors will be corrected without charge to the client.

Color, Materials, and Handmade Character

Color and appearance may vary among screens, printing processes, papers, canvas, finishes, and environmental lighting. These reasonable differences are not considered defects.

Natural hardwood varies in grain, tone, figure, and texture. Minor variations inherent in handmade construction and natural materials are part of the individual character of the finished work.

Client-Provided Materials

The client represents that they own, or have obtained all permissions necessary to use, every photograph and other reference material supplied to Legacy Pet Studio. The client authorizes the studio to use and adapt those materials solely for creating the commissioned artwork.

The client is also responsible for obtaining any permission required from recognizable individuals—or the parent or legal guardian of a minor—appearing in submitted materials. Legacy Pet Studio may request reasonable evidence of ownership or permission when the source or authorized use of any material is uncertain.

Copyright and Client Use

Legacy Pet Studio retains the copyright and all intellectual-property rights in its original artwork unless a separate written agreement expressly provides otherwise.

Purchase of a commissioned portrait includes ownership of the physical finished piece and permission to display it for personal, noncommercial purposes. It does not transfer the right to reproduce, sell, license, substantially alter, commercially exploit, or create derivative products from the artwork.

Portfolio and Promotional Use

Legacy Pet Studio will not use a client’s commissioned portrait for portfolio, exhibition, social-media, publicity, or promotional purposes unless the client provides separate authorization.

Any such permission will be addressed as part of the client relationship and is not granted merely by accepting these Terms.

Delivery and Shipping

Delivery arrangements, shipping charges, and any applicable sales tax will be stated separately. Clients should inspect shipped work promptly and report visible damage within five calendar days of delivery.

A damage report must include photographs of the artwork and the exterior and interior packaging. All original packaging must be retained, and the client must reasonably cooperate with any carrier or insurance claim. Depending upon the circumstances, Legacy Pet Studio may arrange repair, replacement, reprinting, or another appropriate remedy.

Website Content and Permitted Use

The portraits, photographs, text, logo, design elements, and other content appearing on this website are owned by or licensed to Legacy Pet Studio and are protected by applicable intellectual-property laws.

You may view the website for personal, noncommercial purposes. You may not copy, download, reproduce, publish, modify, distribute, sell, or otherwise use website content without prior written permission.

Disclaimers and Limitation of Liability

Legacy Pet Studio makes reasonable efforts to keep this website accurate and available but does not warrant that it will always be uninterrupted, error-free, or current. To the fullest extent permitted by law, the studio is not liable for indirect, incidental, special, or consequential damages arising from use of—or inability to use—the website.

Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded under applicable law.

Governing Law and Disputes

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

The parties will first attempt in good faith to resolve a dispute through direct discussion. If no resolution is reached, either party may propose nonbinding mediation in South Carolina. Any legal proceeding not resolved informally or through mediation will be brought in a court of competent jurisdiction serving Lexington County, South Carolina.

Changes to These Terms

Legacy Pet Studio may update these Terms as its services, website, or business practices change. The effective date above identifies the current version. Continued use of the website after an update constitutes acceptance of the revised Terms.
